Mayangan– Selasa siang, (29/1), di ruang sidang Pengadilan Negeri Kota Probolinggo, kembali di gelar sidang gugatan warga Tongas terhadap RSUD dr. Moch. Saleh Kota Probolinggo dan BPJS Kesehatan. Jika sebelumnya, Hanifah, istri pasien Sudarman, 58, yang meninggal setelah ditolak saat hendak berobat di Poli jantung RSUD menggugat pihak RSUD dan BPJS Kesehatan dengan tuntutan Rp 1 triliun dan Rp 26 Juta dengan tuduhan melakukan perbuatan melanggar hukum.

Namun siang itu, sidang yang dipimpin oleh hakim Sylvia Yudhiastika beragendakan pencabutan gugatan oleh pihak kuasa hukum penggugat Farid Budi Hermawan. Kuasa hukum penggugat mengatakan pencabutan gugatan ini telah melalui persetujuan keluarga almarhum Sudirman.

Dalam persidangan nampak hadir, para tergugat yaitu Kepala BPJS Cabang Pasuruan Debby Nianta Musigiasari dan Kepala Kantor BPJS Kota Probolinggo Mira Estherin. Sedangkan dari pihak rumah sakit yakni Plt Direktur RSUD dr. Moch. Saleh drg. Rubiyati dan Wadir Yanmed dr. Taufiqurrohman.

Karena kedua belah pihak bersepakat dengan pencabutan gugatan, Hakim Ketua kemudian membacakan berkas pencabutan gugatan dan menutup sidang pada siang hari itu. Saat ditemui setelah  persidangan, kuasa hukum pengugat mengatakan bahwa pencabutan gugatan dilakukan berdasarkan permintaan dari Hanifah. “Saya berharap, permasalahan yang dialami oleh almarhum Sudarman menjadi pelajaran buat semua pihak, terutama rumah sakit sehingga tidak terulang kembali. Serta bisa memberikan perhatian lebih kepada keluarga almarhum,” ungkap Farid yang juga merupakan tetangga dari almarhum.

Sementara itu, Kuasa hukum tergugat Kasi Perdata dan Tata Usaha Negara Kejaksaan Negeri Probolinggo, Elan mengatakan bahwa pencabutan gugatan oleh pihak penggugat merupakan hak penggugat. “Saya tahu, bahwa penggugat akan mencabut gugatannya tersebut saat sidang sebelumnya. Hal ini dikarenakan selama sidang berlangsung, Hanifa istri dari almarhum tidak pernah dihadirkan,” ungkapnya. (Malinda/Humas)

 

A trial session on a lawsuit against public hospital RSUD Moch Saleh and health insurance BPJS has again been held on Tuesday (29/1) in the courtroom of the Probolinggo City District Court. It is reported, Hanifah, the wife of a patient Sudarman, 58, who died after being turned down when he was seeking treatment at the heart clinic of the Regional Hospital, has filed a lawsuit against the hospital and health insurance BPJS with demands of IDR 1 trillion and IDR 26 million on charges of violating the law.

The trial presided over by judge Sylvia Yudhiastika was scheduled to revoke the suit by the plaintiff’s attorney, Farid Budi Hermawan. The plaintiff’s attorney said the retraction of the lawsuit had been approved by the family of the late Sudirman.

During the trial, the defendants were the Head of the Pasuruan BPJS Debby Nianta Musigiasari, and the Head of Probolinggo City BPJS, Mira Estherin. Other defendants from the hospital were Acting Director of public hospital RSUD Dr. Moch. Saleh, drg. Rubiyati and Vice Director of Medical Service dr. Taufiqurrohman.

Since both parties have agreed to withdraw the lawsuit, the Presiding Judge then read out the withdrawal of the lawsuit and closed the trial. When met after the trial, the plaintiff’s attorney said that the retraction of the lawsuit was based on a request from Hanifah. “I hope that the problems experienced by the late Sudarman will be a lesson for all parties, especially hospitals so that this will not be repeated. And can give more attention to the family of the deceased,” said Farid who is also a neighbor of the deceased.

Meanwhile, the attorney of the defendant Kasi Civil and Administrative Affairs of the Probolinggo District Attorney, Elan said that the revocation of the claim is the plaintiff’s right. “I know that the plaintiff will withdraw the suit during the previous trial. This is because, during the trial, Hanifa, the wife of the deceased was never presented,” she said.
